1523 – Ahmad bin al Hakam al Basrī narrated to us, saying: Muhammad bin Ja’far narrated to us, on the authority of Shu’bah, on the authority of Mālik bin Anas, on the authority of ‘Amr or ‘Umar bin Muslim, on the authority of Sa’īd bin al Musayyib, on the authority of Umm Salamah, from the Prophet peace and blessings be upon him, that he said: 《Whoever sees the new moon of Dhul Hijjah, and intends to sacrifice, then he should definitely not cut his hair, or his nails》
This is a Hadīth Hasan Sahīh, and what is correct is that it is ‘Amr bin Muslim, Muhammad bin ‘Amr bin ‘Alqamah and more than one other indeed narrated from him, and this Hadīth has been narrated from Sa’īd bin al Musayyib, on the authority of Umm Salamah from the Prophet peace and blessings be upon him, in other ways similar to this.
And it is the saying of some of the people of knowledge, and it is what Sa’īd bin al Musayyib used to say, and this Hadīth is what Ahmad and Ishāq went by.
And some people of knowledge gave concession in this regard,So they said: there is no harm if one cuts their hair and nails, and this is the saying of Ash Shāfi’ī, and he used the Hadīth of ‘Ā’ishah as proof 《Indeed the Prophet peace and blessings be upon him would send the sacrificial animals from Madīnah, and he would not desist from anything that the Muhrim (person in state of Ihrām) would desist from》
